Panda Pay Electronic Communications Consent
This Electronic Communications Consent explains how Panda Pay will provide disclosures, notices, and other information to you electronically, and describes your rights and choices regarding those communications.
By clicking "I Agree," "Continue," or a similar button, creating a Panda Pay account, or continuing to use the Services after being presented with this Consent, you agree to receive required disclosures and other communications from Panda Pay electronically, as described in this Electronic Communications Consent ("Consent"). If you do not agree, you should not use the Services.
1. Title & Introduction
This Consent explains how electronic delivery works for communications related to your use of Panda Pay services. It applies to your use of the Panda Pay mobile application, our website at pandapay.money, and any related tools, features, or accounts (collectively, the "Services").
By accepting this Consent, you agree that we may provide certain communications electronically rather than in paper form, and that your electronic consent has the same legal effect as a handwritten signature or paper agreement.
This Consent forms part of our Terms & Conditions and should be read together with those Terms and our Privacy Policy.
2. Scope of Electronic Communications
Your Consent covers all Communications related to the Services, including but not limited to:
- Policy documents and updates, including our Terms & Conditions and Privacy Policy.
- Regulatory disclosures and any notices required by law to be provided in writing.
- Account notices, transaction confirmations, Cash Flex™ details, and regulatory disclosures under the Electronic Fund Transfer Act (Regulation E).
- Security alerts, fraud notifications, and customer support messages.
- Any other information or documents we provide in connection with the Services.
3. Methods of Electronic Delivery
We may deliver Communications to you electronically in any of the following ways, to the extent permitted by law:
- By email, sent to the email address associated with your Panda Pay account.
- By SMS or text message, sent to the mobile phone number associated with your account.
- By in-app messages or other messages displayed within the Panda Pay app.
- By posting information or documents within your account, on our website, or in another digital location we designate.
We do not send marketing text messages.
We may choose any of these methods for a given Communication. In some cases, we may send an email or notification telling you how to view the Communication electronically (for example, by logging in to the app or website).
Depending on your mobile plan and carrier, message and data rates may apply to SMS or text messages.
4. Technical Requirements
To receive and view electronic Communications, you need a device with internet access, a current web browser, a valid email address, and a mobile phone number. Some documents may require the ability to view PDF files. It is your responsibility to ensure your device meets these requirements.
We recommend that you download or print a copy of this Consent and any important Communications for your records.
5. Paper Copies & Withdrawing Consent
Right to Receive Paper Records
You have the right to receive any disclosure or notice on paper. To request a paper copy of any Communication, email support@pandapay.money with the subject "Paper Copy Request." We may charge a reasonable fee for paper copies, unless prohibited by law, and we will tell you about any fee before providing the copy.
How to Withdraw Consent
You may withdraw your Consent to receive Communications electronically at any time by emailing support@pandapay.money with the subject "Withdraw E-Consent." Withdrawal will take effect within 5 business days of our receipt of your request.
Withdrawal of Consent does not affect the legal validity or enforceability of Communications previously delivered to you electronically before the withdrawal date. Withdrawing consent may result in the closure of your account, as electronic delivery is required to use the Services.
Changes to Technical Requirements
If our hardware or software requirements change in a way that creates a material risk you will not be able to receive electronic Communications, we will notify you and give you the option to withdraw your consent without charge or penalty.
6. Effective Date & Updates
This Consent becomes effective when you first accept it or when you first use the Services after being presented with it, whichever occurs first.
We may update this Consent from time to time. When we make material changes, we will notify you and update the "Last updated" date. Your continued use of the Services after changes take effect means you accept the updated Consent.
